Welcome to LOVEBURN. These Terms & Conditions govern purchases made through LOVEBURN, operated by José Cotelo, an individual entrepreneur registered in France.
By placing an order through our website, you agree to these Terms & Conditions.

2. Products
LOVEBURN sells clothing and related products featuring original LOVEBURN designs.
Our products may be produced and fulfilled on demand by third-party production and fulfillment partners.
We make reasonable efforts to display product descriptions, colors, images and dimensions accurately. However, colors and appearance may vary slightly depending on the customer’s screen, product materials and manufacturing process.
Customers are responsible for checking the product description, size and selected options before placing an order.
3. Prices
Product prices are displayed in the currency indicated on the website.
The price applicable to an order is the price displayed when the customer places the order.
Shipping costs are calculated separately during checkout according to factors including the destination, products ordered, quantity and available shipping method.
Any customs duties, import taxes or other charges imposed by the destination country may be payable by the customer where applicable, unless expressly stated otherwise during checkout.
4. Orders
An order is placed when the customer completes the checkout process and payment is successfully authorized.
After placing an order, the customer will receive an order confirmation by email.
LOVEBURN reserves the right to refuse or cancel an order in legitimate circumstances, including suspected fraud, payment failure, obvious pricing errors or inability to fulfill the order.
If an order is cancelled after payment has been collected, the corresponding amount will be refunded.
5. Payment
Available payment methods are displayed during checkout.
Payments are processed securely through the payment providers available on the LOVEBURN website.
LOVEBURN does not directly store complete payment-card information.
6. Production and Fulfillment
Some LOVEBURN products are produced after an order is placed.
Production times are separate from shipping and delivery times.
Orders may be produced and shipped from different fulfillment locations depending on the customer’s destination, product availability and fulfillment capacity.
7. Shipping and Delivery
LOVEBURN ships to the destinations available during checkout.
Shipping costs are calculated at checkout based on the customer’s destination and order.
Available shipping methods, estimated delivery dates and shipping prices are displayed during checkout where available.
Delivery estimates are estimates and may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather or other logistical disruptions.
Customers are responsible for providing a complete and accurate delivery address.
8. Right of Withdrawal
Where applicable under French and European Union consumer law, consumers purchasing online have a statutory 14-day right of withdrawal, without having to provide a reason.
For goods, the withdrawal period generally begins on the day the customer, or a third party designated by the customer other than the carrier, receives the goods.
To exercise the right of withdrawal, the customer must notify LOVEBURN of the decision to withdraw before the withdrawal period expires.

Certain products may be legally excluded from the right of withdrawal, including goods made to the consumer’s specifications or clearly personalized, where the statutory conditions for that exception are satisfied.
Nothing in these Terms limits any mandatory consumer right provided by applicable law.
9. Returns
If a customer validly exercises a statutory right of withdrawal, the product must generally be returned within 14 days after notifying LOVEBURN of the withdrawal.
Unless otherwise required by law or stated by LOVEBURN, the customer may be responsible for the direct cost of returning a product following a change-of-mind withdrawal.
Products should be returned in a condition allowing LOVEBURN to assess them appropriately. The customer may be responsible for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

10. Damaged, Defective or Incorrect Products
If an item arrives damaged, defective or materially different from what was ordered, please contact LOVEBURN as soon as reasonably possible.
We may request photographs of the item, packaging and shipping label to investigate the problem.
Depending on the circumstances and applicable consumer rights, an appropriate remedy may include replacement, repair, refund or another remedy required by law.
These provisions do not limit the customer’s statutory legal guarantees.
11. Legal Guarantee
Consumers benefit from the mandatory legal guarantees applicable under French and European consumer law, including the legal guarantee of conformity where applicable.
These statutory rights apply independently of any commercial return or refund policy offered by LOVEBURN.
12. Refunds
Where a refund is due, it will normally be issued using the original payment method unless otherwise agreed or required by law.
Processing times may vary depending on the payment provider or financial institution.
Statutory refunds relating to the exercise of the right of withdrawal will be processed within the periods required by applicable law.
13. Intellectual Property
The LOVEBURN name, branding, graphics, artwork, designs, photographs, text and other original content displayed on the website are protected by applicable intellectual-property laws.
They may not be copied, reproduced, distributed, commercially exploited or used without prior authorization, except where permitted by law.
Purchasing a LOVEBURN product does not transfer intellectual-property rights in the design or artwork to the purchaser.

Personal information collected through the website is processed in accordance with our Privacy Policy and applicable data-protection legislation, including the GDPR where applicable.

Please include the relevant order number when contacting us about an existing order.
16. Consumer Mediation
In accordance with French consumer law, consumers have the right to access a consumer mediation procedure free of charge for the amicable resolution of any dispute relating to an order, after first submitting a written complaint to LOVEBURN.
The consumer mediation service applicable to LOVEBURN is currently being established. The contact details of the designated consumer mediator will be published on this website as soon as the affiliation process has been completed.
17. Applicable Law
These Terms & Conditions are governed by French law.
Where the customer is a consumer residing in another country, this choice of law does not deprive the customer of mandatory consumer protections that apply under the law of their country of residence where such protections cannot legally be excluded.
18. Changes to These Terms
LOVEBURN may update these Terms & Conditions when necessary to reflect changes to the website, our business practices or applicable law.
The Terms applicable to an order are those in effect when the order is placed.
